Here’s how we won.

The Case

In Arkansas, landlords are allowed to keep a security deposit only if there is accrued unpaid rent or damages that occurred due to “non-compliance with the rental agreement.” If the landlord elects to keep and apply the security deposit for that reason, the landlord is required by law to provide the tenant with an itemized list of the rent not paid and/or damages no more than 60 days after termination of the lease agreement AR Code § 18-16-305 (2024).

But, what if that doesn’t happen? What if the landlord decides to just keep the deposit without providing any documentation. What if the landlord stonewalls the tenants, and effectively scams them out of thousands of dollars?

Well, when that happens, Arkansas law says that the tenant can be awarded 2X the value of the security deposit (AR Code § 18-16-306 (2024). And, in this case, that is exactly what we got for our client.
