Arkansas wrongful death law and pedestrian fatalities
Under Arkansasās wrongful death statute, Ark. Code Ann. § 16-62-102, families may seek compensation for funeral expenses, lost support, and loss of companionship. Wrongful death claims generally must be filed within three years from the date of death.
In addition, a survival action under Ark. Code Ann. § 16-62-101 may allow the estate to recover damages for medical bills or conscious pain experienced prior to death.
Why pedestrian crashes involving trucks require special review
Fatal pedestrian accidents with tractor-trailers often raise questions about driver attentiveness, visibility, lighting, and roadway design. Attorneys gather dash cam footage, black box data, witness accounts, and crash reconstructions to establish liability. Prompt evidence preservation is essential in these cases.
