After hearing all of the evidence and finding that the prosecution failed to prove its case beyond a reasonable doubt, a Stone County jury returned a Not Guilty verdict for all of our client’s driving-while-intoxicated charges, including a DWI2, open container, and failure to maintain the vehicle.

Charge Reduction And No Prison Time | Three Drug Possession Charges & One Fleeing Charge

The State initially pursued multiple felony drug charges in addition to a Class C felony fleeing allegation. Through negotiations, the defense secured dismissal of all drug-related counts. The client ultimately entered a guilty plea to felony fleeing, substantially narrowing the scope of conviction exposure and eliminating multiple drug convictions from the final disposition.

The State alleged that the defendant committed an unlawful animal attack offense arising from an incident in Bryant, Arkansas. The defense maintained the client’s innocence and proceeded to trial rather than accepting a plea agreement. Following presentation of the evidence, the court entered a verdict of Not Guilty and acquitted the client of the charge in its entirety. 

Because the charge resulted in a complete acquittal, the client avoided all criminal penalties and retained a clean outcome on the case.

After negotiations and trial-level case preparation by the defense team, the State agreed to reduce the charge to Second-Degree Criminal Mischief, a misdemeanor offense. The resolution removed the felony conviction from the case and significantly reduced the long-term consequences facing the client.

  • For class D Felony, client was facing up to six years in prison
  • Client was facing thousands in fines

  • No prison time (1 year of SIS only)
  • Minimal fines (only $100)
  • Avoided a felony conviction
