DWI2 Reduced to DWI1, No Jail Time

Garland County DWI 2 Reduced

Our client went to trial in Hot Springs on a DWI case in which the prosecution sought treatment of the charge as a second offense. During trial, the prosecution did not have the adequate documentation to prove the alleged prior conviction, so the judge amended the DWI Second Offense charge to DWI First Offense.

Our client ultimately received a one-year sentence, but our team got all but one day of that sentence suspended, and the remaining day was credited as time served. The case demonstrates the importance of requiring the prosecution to establish the elements and enhancement evidence necessary to support the offense level it seeks.
